Downtime again

Well suddenly all our databases were gone again and I had a word with the Server people again. This time it was to cope with an extensive overload of the server.
To days in a row is a bit over the top so I asked if the server up time guarantee still was 99.9%
And this guy said:
So if you see a marketing where your server farm guarantees 99.9% up -time you should also get it in writing that the server is actually working during that time
Fubaring the databases is definetly not acceptable and not considered uptime in my book.
But we are still within the 99.9 uptime guarantee anyway I guess - unless it happens tomorrow too...

It is 99.9% uptime for the server. Please keep in mind though that the server itself is still up and running, just that the mysql service is not at the moment.
